In order to use a free or leased instrumental (Non Exclusive), the licensee must agree that Kendoyll Simpson retains the right to collect 50% of composer/publishing share of any song that contains the full or sampled audio of that instrumental. The licensee must also give producer credit to Kendoyll Simpson/KSBEATS and any other producer that collaborates on the production of the instrumental(s) if any. Kendoyll Simpson also retains the right to collect additional revenue from the licensee depending on the commercial use of the instrumental(s) eg. competitions, paid performances, sales/streaming (Digital Music Stores), etc. All distribution and publishing splits for leases (non exclusive purchases) must be handled by Kendoyll Simpson unless Kendoyll Simpson agrees that distribution and publishing can be handled by another entity other than himself. However, any licensee that wishes to obtain exclusive rights to their song(s) on any of the instrumentals from our beats catalog can only purchase exclusive rights to their song(s) (royalty free) and not exclusive rights to the instrumental itself. Custom Beats Terms and Conditions:

The licensee has full rights to custom made instrumental(s) after full payment is received. The instrumental(s) will be available to the licensee exclusively. In addition, the licensee will be able to use the instrumental royalty free. All custom made instrumentals require a 50% deposit of the total fee for production to commence and the remaining 50% upon completion.

If the remaining balance of an instrumental is not paid in full within 30 days from the start date of the project, Kendoyll Simpson retains the right to keep the initial deposit and sell the instrumental to another artist in order to recover funds.
